Abstract
After the settlement of the indigenous peoples in Chile, from 1930 to 1993, the legislation aimed at regularizing the possession and ownership of land in the so-called southern zone regarding the division of the indigenous communal property and the constitution of individual property. The author analyzes the contribution of Chilean jurists to the practical application of this regulation. Terminada la etapa de las radicaciones de los indígenas en Chile, a partir de 1930 y hasta 1993, la legislación dictada respecto de los naturales tuvo como objetivo regularizar la tenencia, posesión y propiedad de la tierra en la llamada zona austral y por otro lado, dividir la propiedad comunitaria indígena, constituyendo una propiedad individual. Se analiza el aporte de los juristas chilenos en torno a la aplicación práctica de esta normativa.
