Corporate social responsibility (hereinafter, CSR) contributes to sustainable development. It ensures the presence of business activity with positive impacts on society and its environment. Its main feature is voluntary compliance because it is an ethical business practice. This paper, however, analyzes and postulates CSR as a mandatory mandate in the Constitutional State, like compliance with it is not a matter of good will or an ethical practice. This is because CSR is a tool and strategy capable of promoting care for the fundamental right to a healthy and balanced environment. If this is so, then compliance becomes imperative, because companies have a duty to respect, protect and conserve the environment. In addition, in the Constitutional State, public and private authorities are obliged to act in accordance with the rights and fulfillment of the Constitution. In this context, it is an obligation to comply with and implement strategies that promote rights, and CSR is an instrument that companies should implement to protect the environment and legitimize the development of their activities, especially extractive activities, which are often a source of conflict.La responsabilidad social empresarial (en lo posterior, RSE) contribuye al desarrollo sostenible. Asegura la presencia de la actividad empresarial con impactos positivos en la sociedad y su entorno. Su principal rasgo es el cumplimiento voluntario porque se trata de una práctica ética empresarial. Este trabajo, sin embargo, analiza y postula la RSE como un mandato obligatorio en el Estado Constitucional, es decir, su cumplimiento no se trata de un asunto de buena voluntad o una práctica ética. Ello al constatar que la RSE es una herramienta y estrategia capaz de promover el cuidado del derecho fundamental al medio ambiente sano y equilibrado. Si ello es así, por consiguiente, su cumplimiento se torna en imperativo, porque las empresas tienen el deber de respetar, proteger y conservar el ambiente. Y, sumado a eso, en el Estado Constitucional los poderes públicos y privados están obligados a actuar conforme a los derechos y la realización de la Constitución. En tal contexto, cumplir e implementar estrategias que promuevan los derechos es una obligación, siendo así, la RSE es un instrumento que debe implementarse por las empresas para proteger el medio ambiente y legitimar el desarrollo de sus actividades, en especial, las de carácter extractiva que son muchas veces fuente de conflictos.
