The loss of biodiversity is one of the elements of the current triple planetary crisis that affects humanity. To deal with this problem, international and national legal systems have proposed, and developed new biodiversity protection schemes with a different scope focused on avoiding and reversing biodiversity loss. In this context, it is necessary to analyze whether a biodiversity law is required in Colombia and, if the answer is affirmative, what would be the main elements that should be regulated through this legal instrument. Starting from an analysis of the new international developments in terms of biodiversity protection and a comparative review of some countries with biodiversity laws, this article aims to analyze whether the Colombian legal framework has sufficient elements to deal with the loss of biodiversity and reverse it; or, if the contrary, a biodiversity law is required, in which case some elements that should be included in said regulation will be proposed.La pérdida de biodiversidad es uno de los elementos de la actual triple crisis planetaria que afecta a la humanidad. Con el fin de hacer frente a esta problemática, los sistemas jurídicos, tanto internacionales como nacionales, han venido proponiendo y desarrollando nuevos esquemas de protección de la biodiversidad, con un alcance diferencial, enfocado no solo en evitar, sino en revertir la pérdida de la biodiversidad. En este contexto, se hace necesario analizar si se requiere una ley de biodiversidad en Colombia, y en caso de que la respuesta sea afirmativa, cuáles serían los principales elementos que se deben regular a través de este instrumento jurídico. Partiendo de un análisis de los nuevos desarrollos internacionales en materia de protección de la biodiversidad y de una revisión comparada de algunos países con leyes de biodiversidad, este artículo tiene por objetivo analizar si el marco jurídico colombiano tiene los elementos suficientes para hacer frente a la pérdida de biodiversidad y revertirla, o, si por el contrario, se requiere de una ley de biodiversidad, en cuyo caso se propondrán algunos elementos que deben incluirse en dicha regulación.
