| dc.description | As a result of the climate crisis, there is a need to establish a legal framework to protect people who, affected by environmental conditions, must move from their territories, prioritizing sectors that suffer greater vulnerability, such as children and adolescents. In this context, this study analyzes the possible regulation applicable to minors persons who must migrate for environmental reasons, in order to satisfy the integral protection of their rights, in particular, the guarantee of non-refoulement, extensible to their family nucleus. To this extent, using a dogmatic methodology and the systematic and factual methods, it is concluded that (i) although the regulation on refuge, contained mainly in the Convention of Geneva of 1951, is not compatible with the nature of environmental displacement, (ii) based on a harmonious interpretation of the Convention on the Rights of the Child and the Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, and the General Comments of their respective Committees, it does allow States to fully protect children and adolescents in compliance with the principle of the best interests of the child and the guarantee of family unity. | en-US |
| dc.description | Con la crisis climática, surge la necesidad de establecer un marco jurídicoque proteja las personas que, afectadas por las condiciones ambientales, deben desplazarsede sus territorios, priorizándose sectores que sufren mayor vulnerabilidad, comolos niños, niñas y adolescentes. En este contexto, el presente estudio analiza la posible regulación aplicable a las personas menores de edad que deben migrar por razones ambientales, con el fin de satisfacer la protección integral de sus derechos, en particular, la garantía de no devolución, extensible a su núcleo familiar. En tal medida, usando una metodología dogmática y los métodos sistemático y enjuiciamiento de hecho, se concluye que i) si bien la regulación frente al refugio, contenida principalmente en la Convención de Ginebra de 1951, no resulta compatible con la naturaleza del desplazamiento ambiental, ii) a partir de una interpretación armónica de la Convención sobre los Derechos del Niño y la Convención sobre la Protección de los Derechos de Todos los Trabajadores Migratorios y de sus Familiares, y las Observaciones Generales de sus respectivos Comités, sí permite que los Estados protejan integralmente a los niños, niñas y adolescentes bajo el cumplimiento del principio de interés superior del niño y la garantía de la unidad familiar. | es-ES |
