This document analyzes the impact of the megaproject called the Mayan train that is being developed in the Gulf-Southeast region of Mexico on the collective rights of indigenous peoples and communities, from two legal approaches: the new Latin American constitutionalism and Mexican legal pluralism,with the purpose of identifying the best solution to the conflicts related to the execution of said project, and the possible violation of human rights.El presente documento analiza el impacto del megaproyecto denominado tren maya que se desarrolla en la región golfo-sureste de México en los derechos colectivos de los pueblos y comunidades indígenas, desde dos enfoques jurídicos: el nuevo constitucionalismo latinoamericano y el pluralismo jurídico mexicano, con la finalidad de identificar la mejor alternativa de solución a los conflictos relacionados con la ejecución de dicho proyecto y la posible violación de derechos humanos.
