dc.descriptionThe article evaluates the sense and approach of the article 18 of Rome Statute and the possibility of interrupting an investigation under analysis by de Office of the Prosecutor of the International Criminal Court. Among other considerations, the article develops the Prosecutor’s duty to notify the States about the opening of an investigation, the standard of proof that applies at this phase, and the investigation’s interrupting as a general rule. The article also includes some considerations concerning the initial treatment of the Afghanistan, The Philippines, and Venezuela I situations.en-US
dc.descriptionEl artículo examina el sentido y alcance del procedimiento que faculta a los Estados a pedir la inhibición de la competencia del Fiscal respecto a aquellas situaciones en las que se ha abierto una investigación formal. Para tal fin se analizan, entre otras cosas, la obligación de la Fiscalía de notificar a los Estados acerca del inicio de la investigación, el estándar probatorio aplicable, la inhibición de la competencia del Fiscal como regla general y la continuación de la investigación en la sede de la CPI como excepción. De igual forma, se incorporan algunas observaciones sobre el tratamiento inicial dado por la jurisprudencia de la CPI a las situaciones de Afganistán, Filipinas y Venezuela I.es-ES
