dc.descriptionThe purpose of this article is to analyze the declaration of satisfactory and unsatisfactory execution of the Environmental Compliance Programs by the Superintendence of the Environment, due to the relevant effects that such determination has within the sanctioning procedure, being this instrument the most used incentive mechanism for environmental compliance by the regulated parties. For this purpose, the regulations applicable to the Compliance Programs and their purpose, the supervisory power of the Superintendence of the Environment, some cases where the environmental authority declared its execution unsatisfactory, the jurisprudential criteria in this respect and the challengeability of the administrative act that pronounces on the execution of this instrument will be reviewed. Finally, in view of the lack of legal and regulatory regulation on criteria to determine whether a Compliance Program was executed satisfactorily or unsatisfactorily, some criteria will be proposed for its determination in accordance with the purpose of this instrument, which is the promotion of environmental compliance and the protection of the environment.en-US
dc.descriptionEl presente artículo tiene por objetivo analizar la declaración de la ejecución satisfactoria e insatisfactoria de los Programas de Cumplimiento ambiental por parte de la Superintendencia del Medio Ambiente, debido a los relevantes efectos que tiene aquella determinación dentro del procedimiento sancionatorio, siendo este instrumento el mecanismo de incentivo al cumplimiento ambiental de mayor uso por parte de los regulados. Para ello se revisará la normativa aplicable a los Programas de Cumplimiento y su finalidad, la facultad fiscalizadora de la Superintendencia del Medio Ambiente, algunos casos donde la autoridad ambiental declaró su ejecución insatisfactoria, los criterios jurisprudenciales a este respecto y la impugnabilidad del acto administrativo que se pronuncia sobre la ejecución de este instrumento. Finalmente, atendida la inexistencia de regulación legal y reglamentaria sobre criterios para determinar si un Programa de Cumplimiento fue ejecutado satisfactoria o insatisfactoriamente, se propondrán algunos criterios para su determinación de conformidad con la finalidad de este instrumento, consistente en la promoción del cumplimiento ambiental y la protección del medio ambiente.es-ES
