Abstract
At paper proposes that the patrimonial liability of the Administration is not only based on the fault of the public service as the only title of attribution of liability, as has been accepted in a uniform manner by the jurisprudence, but that it is legally possible that, together with the fault of public service, coexist other imputation titles that establish exceptional liability systems without fault, based on a correct interpretation of article 4° of the General Law of General Bases of the State Administration. El presente trabajo propone que la responsabilidad patrimonial de la Administración no sólo se fundamenta en la falta de servicio como único título de imputación de responsabilidad, según lo ha aceptado de manera uniforme la jurisprudencia, sino que es jurídicamente posible que, conjuntamente con la falta de servicio, coexistan otros títulos de imputación que establezcan regímenes excepcionales de responsabilidad sin falta, sobre la base de una correcta interpretación del artículo 4° de la Ley General de Bases Generales de la Administración del Estado.
