| dc.description | As it is known, the Chilean Act number 20.720 implied a complete change in the local bankruptcy system. From the old bankruptcy, instated by the Act number 18.175 and afterwards incorporated to the Book IV of the Chilean Commercial Code, the system evolved to one called Reorganization and Liquidation for Companies and People. However, this reform did not refer to the cession of goods since it was not abrogated but directly recognized; and its procedure is not undertaken on this new Act. The purpose of this work is to explain, throughout the current rules, which is the procedure to enforce this institution. | en-US |
| dc.description | Como es sabido, la Ley Nº 20.720 implicó un completo cambio en el sistema concursal chileno. De la antigua quiebra, establecida en la Ley Nº 18.175 y después incorporada al Libro IV del Código de Comercio, se pasó a un sistema denominado de Reorganización y Liquidación de Empresas y Personas. Sin embargo, esta reforma no contempló expresamente al pago por cesión de bienes, ya que, por una parte, no fue derogado, sino que expresamente reconocido, pero su procedimiento, contemplado en la antigua Ley de Quiebras, no figura en la nueva ley. El propósito del presente trabajo es explicar, a partir de las disposiciones legales existentes, cuál es el procedimiento a aplicar al pago por cesión de bienes. | es-ES |
