dc.descriptionThe article's objective is to examine the possible liability arising from the breach of the right to education of children and adolescents attending primary and secondary public schools against the State under civil law due to the poor implementation of internet services and thus limited access to distance learning, by seeking to prove the existence of real damage caused by the lack of foresight of the State when implementing distance learning in the context of COVID-19. It is structured in three chapters: The first sets out the children and adolescents' right to education and the applicable regulatory framework. The second analyses and explains the competent State Administration bodies' breaches of the right to education in the context of a pandemic. The third explores the possibility of amending the liability of the State under civil law arising from the breach of the fundamental right to education during a pandemic.en-US
dc.descriptionEl presente trabajo tiene como objetivo probar la posibilidad de imputar responsabilidad civil en contra del Estado por falta de servicio por la vulneración del derecho a la educación de niños, niñas y adolescentes que cursan la enseñanza básica y media en el sistema escolar público por la falta de conectividad al servicio de internet para acceder a las clases telemáticas, buscando probar la existencia de un daño real producido por la falta de previsión del Estado al implementar un modelo telemático de clases en contexto de COVID-19. Se estructura en tres capítulos; en el primer capítulo, se describe el contenido del derecho a la educación que tienen los NNA y se determina el marco normativo aplicable en esta materia. En el segundo capítulo, se analiza y explica la vulneración del derecho a la educación en el contexto de pandemia por parte de los órganos de la Administración del Estado competentes en esta materia. En el tercer capítulo, se estudia la posibilidad de configurar la responsabilidad civil del Estado ocasionada por la vulneración del derecho fundamental de educación en tiempos de pandemia.es-ES
