| dc.description | El presente trabajo tiene por objetivo exponer y analizar algunas materias relativas a los organismos autónomos constitucionales. En concreto, se revisarán las principales definiciones elaboradas por la doctrina y la jurisprudencia constitucional con la finalidad de desentrañar el núcleo esencial de dicha autonomía, los fundamentos argüidos para consagrar organismos autónomos constitucionales y el diseño regulatorio de estos en el ordenamiento jurídico chileno. Finalmente, se analizará la crítica efectuada por un sector de la doctrina que postula que, en el sistema nacional, los organismos autónomos constitucionales –en particular el Banco Central y el Tribunal Constitucional– adolecen de legitimidad por ser custodios de un orden ideológico impuesto por el constituyente de 1980. | es-ES |
| dc.description | This paper aims at presenting and analyzing certain issues related to the constitutional autonomous institutions. In particular, the present paper reviews the main definitions developed by the constitutional literature and caselaw with the purpose of determining the essential core of such autonomy, the grounds argued for establishing constitutional autonomous institutions, and the regulatory design of such institutions within the Chilean legal system. Finally, the criticism raised is analyzed by part of the authors, which claims that, in this legal system, the constitutional autonomous institutions –particularly the Central Bank and the Constitutional Court– lack of legitimacy due to their character of custodians of an ideological order imposed by the 1980 constituent. | en-US |
