| dc.description | Sexual crimes in an ecclesiastical context usually present a significant delay in their reporting, which generates procedural problems of evidence, as well as questions and doubts towards the victims. For example, why didn’t they count earlier? Why now, after so long?In this order of ideas, this article offers a theoretical approach to the problem of temporality, around the denunciation of sexual crimes, and particularly those that occur in ecclesiastical contexts. In this way, it begins with a review of the evidence and the contributions of the investigation, tending to characterize sexual abuse in this context, and the variables that are associated with the difficulties that survivors face in denouncing in the terms defined by the penal system law. This is linked to the deep psychological and spiritual damage that is usually generated after a sexual crime committed by a representative of the church, added to the factors that make disclosure, notification and denunciation difficult, including the neutralization techniques used by the perpetrators and by the institution itself. Added to this are cultural variables that mediate the responses provided by the justice administration system operators. Based on this, we reflect from a victimological approach on the implications of all this in the prescription rules of this type of crime. | en-US |
| dc.description | Los delitos sexuales en entornos eclesiásticos suelen presentar una dilación importante en su denuncia, lo que genera problemas procesales de prueba, además de cuestionamientos y dudas hacia las víctimas. Por ejemplo, ¿Por qué no contaron antes?, ¿por qué ahora, después de tanto tiempo?En este orden de ideas, el presente artículo ofrece una aproximación teórica al problema de la temporalidad, en torno a la denuncia de delitos sexuales, y particularmente aquellos ocurridos en contextos eclesiásticos. De este modo, comienza por una revisión de la evidencia y los aportes de la investigación, tendiente a caracterizar el abuso sexual en este contexto, y las variables que se asocian a las dificultades que enfrentan los sobrevivientes para denunciar dentro de los plazos definidos por el sistema jurídico-penal. Ello se vincula al profundo daño psíquico y espiritual que suele generarse luego de un delito sexual a cargo de un representante de la Iglesia, sumado a los factores que obstaculizan la develación, notificación y denuncia, incluidas las técnicas de neutralización empleadas por los perpetradores y por la propia institución. A esto se añaden variables culturales que median las respuestas brindadas por los operadores del sistema de administración de justicia. Basado en ello, se reflexiona desde una aproximación victimológica acerca de las implicancias de todo esto en las reglas de prescripción de este tipo de delitos. | es-ES |
