This research analyzes the main elements of the recovery action that article 69 letter a) of Law 16,744 grants to the administrative bodies of the compulsory insurance that it establishes for the benefits that they have granted or should grant in the cases of accidents of the work derived from the guilt or intent of the employer or a third party. We note the practical disuse of the actionand the distortions that this leads to the operation of the entire Chilean model of compensation for damages derived from labor misfortunes. The validity of the action is demonstrated with two judicial cases that have accepted it and that are reviewed, and its potentiality seems evident, especially when comparing statistics of accidents that have occurred and costs associated with them.En esta investigación se analizan los principales elementos de la acción de repetición que el artículo 69 letra a) de la Ley 16.744 concede a los organismos administradores del seguro obligatorio que ella establece por las prestaciones que hayan otorgado o deban otorgar en los casos de accidentes del trabajo que deriven de culpa o dolo de la entidad empleadora o de un tercero. Se constata el desuso práctico de la acción y las distorsiones que ello conlleva al funcionamiento de todo el modelo chileno de resarcimiento de daños derivados de infortunios laborales. La vigencia de la acción queda demostrada con dos casos judiciales que la han acogido y que son reseñados y su potencialidad parece evidente al confrontar estadísticas de accidentes ocurridos ycostos asociados a ellos.
