| dc.description | The article analyzes the treatment that the withdrawal of trust gets in the Peruvian legal system. It is suggested that it must be re-examined under the influence of the protective principle. This will prevent workers with a relationship of exclusive trust from being left out of the protection against dismissal granted by the Constitution to all workers, without exception. The practical utility of the protective principle to fulfill this purpose is evident. By having been nourished by the theory of the effectiveness of fundamental rights in the field of the company and including within its content the requirement of causality as a limit to the business termination decision, the principle becomes the most important mechanism for the integration of the law in the absence of rules that regulates the withdrawal of trust. | en-US |
| dc.description | El artículo analiza el tratamiento que recibe el retiro de confianza en el ordenamiento jurídico peruano. Se plantea que aquel debe reexaminarse bajo el influjo del principio protector. Así se evitará que los trabajadores con relación de exclusiva confianza se queden al margen de la protección frente al despido otorgada por la Constitución a todos los trabajadores, sin excepción. Se deja en evidencia la utilidad práctica del principio protector para cumplir tal finalidad. Al haberse nutrido de la teoría de la eficacia de los derechos fundamentales en el ámbito de la empresa e incluir dentro de su contenido la exigencia de causalidad como límite a la decisión extintiva empresarial, el principio se convierte en el mecanismo más eficaz para la integración del derecho frente a la ausencia de norma que regule el retiro de confianza. | es-ES |
