dc.descriptionEste artículo analiza las decisiones adoptadas por el Consejo para la Transparencia en torno al acceso a información sobre los procesos de negociación y firma de contratos entre el Estado chileno y distintos laboratorios para adquirir vacunas contra el COVID-19. A partir de la revisión de la jurisprudencia en la materia, se estudia el modo en que se han ponderado derechos en conflicto, como se operativiza el acceso a la información pública de los referidos contratos, así como el alcance y la forma en que se interpretan las causales de reserva de la legislación chilena. El artículo muestra si bien el Consejo estableció la publicidad de los actos de los órganos estatales en esta materia, datos críticos de los referidos acuerdos fueron considerados reservados. Esto, porque se consideró que la publicidad de esta información afectaría el interés nacional, la salud pública del país. A la vez, se estableció que la divulgación de ciertos datos sensibles y estratégicos lesionarían intereses y derechos comerciales y económicos de los laboratorios contratantes.es-ES
dc.descriptionThis article analyzes the decisions adopted by the Council for Transparency regarding access to information on the processes of negotiating and signing contracts between the Chilean State and different laboratories to vaccines against COVID-19. Based on a review of the jurisprudence on the subject, this article studies the way in which conflicting rights have been weighed, how access to public information in those contracts is operationalized, as well as the scope and way in which the grounds for confidentiality in Chilean legislation are interpreted. The article shows that although the Council established the public character of the acts of State bodies on this matter, critical data from the above-mentioned agreements were considered confidential. This is because it was considered that publicizing this information would affect the national interest, the public health of the country. At the same time, it was established that the disclosure of certain sensitive and strategic data would harm commercial and economic interests and rights of the contracting laboratories.en-US
