| dc.description | This article deals with the analysis of soft law, in terms of its conceptualization, its characteristics, and its situation about public international law, to determine its role as a source of international law. It incorporates references to comparative constitutional regulation, such as the cases of Mexico, Argentina, and Spain, as well as to the role of custom as a source of public international law. It concludes the work with well-founded recommendations regarding the inconvenience of including soft law in a constitutional text. | en-US |
| dc.description | Analizamos el soft law, en cuanto a su conceptualización, sus características y su situación frente al derecho internacional público, para llegar a determinar su rol como fuente del derecho internacional. Para ello, incorporamos referencias a la regulación constitucional comparada, como son los casos de México, Argentina y España, junto al papel que cumple la costumbre como fuente del derecho internacional público. Concluye el trabajo con fundadas recomendaciones referentes a la inconveniencia de incluir el soft law en un texto constitucional. | es-ES |
