The present work intends to elucidate the legal nature and effects of the seller’s representation regarding the absence of encumbrances over the sold good. To this end, the paper starts with an analysis of the nature and function of representations and warranties as an institution of contract law, and continues with a specific study of the seller’s representation regarding the ab­sence of encumbrances over the sold good. In such context, it was required to study the potential relationship of the above-mentioned declaration with the obligations that the contract of sale naturally imposes on the seller, and to review the existing national case law on the subject. Finally, reflections to harmonize the seller’s representations about the absence of encumbrances with our legal system are proposed.El presente trabajo pretende dilucidar cuál es la naturaleza jurídica y efectos de la declaración del vendedor respecto de la ausencia de gravámenes en la cosa que vende. Para ello, el trabajo comienza con un análisis de la naturaleza y función de las declaraciones y garantías como insti­tución del Derecho de los contratos, para luego seguir a un estudio pormenorizado de la declaración en cuestión. En ese contexto, fue necesario estudiar la potencial relación de la declaración acerca de ausencia de gravámenes con las obligaciones del vendedor bajo el contrato de compraventa, y revisar la jurisprudencia nacional que existe en la materia. Finalmente, se proponen reflexiones para armonizar la declaración del vendedor relativa a la ausencia de gravámenes con nuestro ordenamiento jurídico.
