| dc.description | In the constitutional order of all Western States, public security is configured in objective terms. This is framed as a public interest linked to a situation of orderly and peaceful coexistence, an essential precondition for the exercise of other fundamental rights, or as an objective interest of the State and of the legal system and, therefore, of the community. The idea of public security is configured: as a limit to the exercise of freedoms and as a task, legislative and administrative, of the public powers and of the State apparatus. The security police function consists of the administrative activity aimed at guaranteeing public order. The article analyzes the conditions for the exercise of this administrative power with reference to the Italian legal system. | en-US |
| dc.description | En el ordenamiento constitucional de todos los Estados occidentales, la seguridad pública se configura en términos objetivos. Esta se enmarca como un interés público vinculado a una situación de convivencia ordenada y pacífica, una condición preparatoria indispensable para el ejercicio de otros derechos fundamentales; o como interés objetivo del Estado y del ordenamiento y, por tanto, de la comunidad en su conjunto. La idea de seguridad pública se configura como límite al ejercicio de las libertades y como tarea, legislativa y administrativa de los poderes públicos y, en particular, del aparato del Estado. La función de policía de seguridad consiste en la actividad administrativa dirigida a garantizar el orden público. Este artículo analiza las condiciones para el ejercicio de este poder administrativo con referencia al ordenamiento jurídico italiano. | es-ES |
