dc.descriptionEnvironmental Impact Assessment (EIA) avoidance is an infraction that has been primarily regulated in the Organic Law of the Superintendency of the Environment (LOSMA) and, more recently, in Law No. 21,595 on economic crimes. This study focuses on EIA avoidance as an administrative infraction (Article 35, letter b of the LOSMA) and on the procedures that the Superintendency of the Environment (SMA) uses to address it. The SMA employs two discretionary procedures to address this infraction: a regular punitive procedure and a special procedure known as “requirement for submitting to EIA”. Both procedures serve different purposes: the first aims to impose a sanction (with a punitive and deterrent objective), while the second aims to ensure compliance with regulation by subjecting avoidant activities to EIA without imposing a penalty (with a corrective objective). This discretionary power has been recognized by jurisprudence based on the administrative principles of opportunity, efficiency, and effectiveness. The objective of this study is to analyze the value of the requirement for submitting to EIA procedure. This, from the perspective of achieving its corrective purpose and to assess whether it can serve the broader interests of the SMA's supervisory work. It questions whether it is acceptable to solely demand the submission of a project in avoidance to EIA, mitigating the punitive function and its deterrent effect regarding this kind of infraction.en-US
dc.descriptionLa elusión al SEIA corresponde a una infracción que ha sido regulada primeramente en la LOSMA y, recientemente, en la Ley N°21.595 sobre delitos económicos. Este estudio se enfoca en la elusión como infracción administrativa (artículo 35, letra b), LOSMA) y en los procedimientos que la SMA utiliza para abordarla. Este organismo utiliza, discrecionalmente, dos procedimientos para abordar esta infracción: uno ordinario, procedimiento sancionatorio y, otro especial, conocido como “requerimiento de ingreso al SEIA”. Ambos procedimientos persiguen fines diferentes: el primero, tiene como propósito cursar una sanción (objetivo punitivo y disuasivo), mientras que el segundo, tiene como horizonte instar al cumplimiento de la normativa, a través del sometimiento de la actividad elusiva al SEIA, sin cursar una sanción al efecto (objetivo correctivo). Esta facultad discrecional ha sido reconocida por la jurisprudencia, en función de la aplicación de los principios de oportunidad, eficiencia y eficacia administrativa. El objetivo de este estudio es analizar el valor del procedimiento de requerimiento de ingreso al SEIA, desde la perspectiva del cumplimiento de su finalidad correctiva, y si este procedimiento puede satisfacer los intereses generales de la labor fiscalizadora de la SMA, cuestionando si es tolerable únicamente exigir el ingreso de un proyecto en elusión al SEIA y morigerar la función de la sanción como un aspecto disuasivo para este tipo de infracción.es-ES
