| dc.description | The purpose of this paper is to determine the legal nature of coercive fines and to analyze some of the consequences deriving therefrom. To this end, it will be examined whether coercive fines are more similar to administrative sanctions or to mechanisms for the enforcement of administrative acts. Then, with regard to the legal consequences: the possibility of applying sanctions and coercive fines jointly; the moment from which they should be counted; and finally, the main elements that make up the legal regime of coercive fines conceived as administrative sanctions will be analyzed. This analysis will be carried out taking as a hypothesis of study the provisions of Article 38 of the General Telecommunications Law. | en-US |
| dc.description | Este trabajo tiene por propósito el estudio y la determinación de la naturaleza jurídica de las multas coercitivas y el análisis las principales consecuencias jurídicas que se derivan de la misma. Para ello, se examinará si las multas coercitivas resultan más asimilables en su naturaleza a las sanciones administrativas o si, en cambio, se asemejan a los mecanismos de ejecución de los actos administrativos. Luego, en cuanto a las consecuencias jurídicas: se analizará la posibilidad de aplicar de manera conjunta sanciones y multas coercitivas; el momento a partir del cual la multa coercitiva debe ser contabilizada; y, por último, los principales elementos que componen el régimen jurídico de las multas coercitivas concebidas como sanciones administrativas. Este análisis será realizado tomando como hipótesis de estudio lo dispuesto en el artículo 38 de la Ley General de Telecomunicaciones. | es-ES |
