| dc.description | he purpose of the work is to establish the system of judicial control of administrative acts in Chile, within the framework of the general system of control of the formal acts of the Administration. In this sense, it is affirmed that it is a control of strict law that extends both to the vices of legality and constitutionality, covering the areas of discretion that the legislator hands over to the administrative bodies at the time of exercising the sanctioning power (not these are fully regulated powers) and that it is not possible to substitute the administrative decision, except in the determination of the quantum of the sanction, in accordance with the rule of precedent. | en-US |
| dc.description | El trabajo tiene por objeto establecer el sistema de control judicial de los actos administrativos en Chile, en el marco del sistema general de control de los actos formales de la Administración. En tal sentido, se afirma que se trata de un control de derecho estricto que se extiende tanto a los vicios de legalidad como de constitucionalidad, abarcando los ámbitos de discrecionalidad que el legislador entrega a los órganos administrativos al momento de ejercer la potestad sancionadora (no se trata de potestades plenamente regladas), aun cuando no es posible sustituir la decisión administrativa, salvo en la determinación del quantum de la sanción, conforme a la regla del precedente. | es-ES |
