| dc.description | This study analyzes the characteristics of the powers of the Administration when exercising its activity in a responsive manner, identifying risks and aimed at guaranteeing the common good; Likewise, it analyzes the powers that the Superintendency of Health Services, the Superintendence of Electricity and Fuels, the Ministry of Transportation and the Undersecretariat of Telecommunications have attributed in Chile to supervise the public services offered in their respective areas of action; and argues how these powers can be used by said authorities according to the concepts of responsiveness, risks and guarantee proposed by foreign and national dogmatics, as well as by organizations such as the OECD, without the need for legislative reforms, with the purpose of contributing to enhance the inspection and regulation tasks of the aforementioned authorities. | en-US |
| dc.description | Este estudio analiza los rasgos que presentan las potestades de la Administración al ejercer su actividad de forma responsiva, identificando riegos y orientada a garantizar el bien común; asimismo, analiza las potestades que en Chile tienen atribuidas la Superintendencia de Servicios Sanitarios, la Superintendencia de Electricidad y Combustibles, el Ministerio de Transporte y la Subsecretaría de Telecomunicaciones para supervisar los servicios públicos ofrecidos en sus respectivos ámbitos de actuación; y argumenta de qué forma esas potestades pueden ser utilizadas por dichas autoridades según los conceptos de responsividad, riesgos y garantía propuestos por la dogmática extranjera y nacional, así como por organizaciones como la OCDE, sin necesidad de reformas legislativas, con el propósito de contribuir a potenciar las tareas de fiscalización y regulación de las mencionadas autoridades. | es-ES |
