| dc.description | The legal panorama regarding agricultural production in Chile is poor and contradictory. The Civil Code considers that they are domestic animals, therefore, movable things. However, the right to property over non-human animals has suffered - and will probably continue to suffer - significant limitations coming from criminal law and the progressive integration of the notion of sentience into legal systems. Today, it is necessary to clarify the legal category to which non-human animals belong and increase the standard of protection of their physical integrity, which is far from the international standards of international organizations such as the World Organization for Animal Health (hereinafter, by its acronym in English, OIE), the revision of these to a minimum being a deliberate choice of the Chilean legislator. | en-US |
| dc.description | El panorama jurídico relativo a la producción agropecuaria en Chile es pobre y contradictorio. El Código Civil considera que son animales domésticos, por lo tanto, cosas muebles. Sin embargo, el derecho de propiedad sobre los animales no humanos ha sufrido -y probablemente seguirá sufriendo- significativas limitaciones provenientes del derecho penal y de la progresiva integración de la noción de sintiencia en los ordenamientos jurídicos. Hoy, resulta necesario aclarar la categoría jurídica a la que pertenecen los animales no humanos e incrementar el estándar de protección de la integridad física de estos, que dista mucho de los estándares internacionales de organismos internacionales como la Organización Mundial de Sanidad Animal (en adelante, por su acrónimo en inglés, OIE), siendo la revisión de estos a minima una elección deliberada del legislador chileno. | es-ES |
