The purpose of this work is to present critical observations to Law No. 21,331, which aims to comprehensively address the rights of people in terms of mental health, a regulation that, despite being oriented towards a human rights approach, in results is far from such a vision, its application is not harmonized with other regulatory bodies, leaving numerous guarantees and rights in the nebula, it still does not have its Regulations despite having been published on May 11, 2021, and ultimately does not fulfills what it promises: recognize and protect people’s rights in terms of mental health.Este trabajo tiene por objeto dar a conocer observaciones críticas a la Ley 21.331, que tiene por fin abordar de manera integral los derechos de las personas en materia de salud mental, normativa que, pese a orientarse a un enfoque de derechos humanos, en los resultados se aleja de tal visión y no se armoniza en su aplicación con otros cuerpos normativos, lo que deja en la nebulosa numerosas garantías y derechos. Aún no cuenta con su reglamento pese a haber sido publicada el 11 de mayo de 2021, y, en definitiva, no cumple lo que promete: reconocer y proteger derechos de las personas en materia de salud mental.
