| dc.description | The present research addresses, in its first part, the increasing threat faced by particularly vulnerable groups in accessing adequate food, in the context of climate change. It highlights the emergence of guaranteeing developments in international and national legal instruments that seek to safeguard this fundamental right. Subsequently, the specific situation in Chile is examined, exploring international standards on climate change and their interaction with the right to food. To this extent, based on a descriptive and explanatory research, using the dogmatic methodology —classical of the legal sciences— and the systematic, analytical and factual sub-methods, the implementation of these standards in the Chilean context is critically observed, analyzing the justiciability mechanisms that seek to ensure the protection and effective realization of the right to food in a scenario of climate change. Finally, it is concluded that is imperative to adopt legal measures of protection of human right to adequate food, by incorporating the international law minimum standards on this matter. | dc.description | Esta investigación aborda, en su primera parte, la creciente amenaza que enfrentan los grupos especialmente vulnerables para acceder a una alimentación adecuada, en el contexto del cambio climático. Se destaca la emergencia de desarrollos garantistas en instrumentos jurídicos internacionales y nacionales que buscan salvaguardar este derecho fundamental. Posteriormente, se examina la situación específica de Chile, se exploran los estándares internacionales sobre cambio climático y su interacción con el derecho a la alimentación. En tal medida, a partir de una investigación descriptiva y explicativa, que emplea la metodología dogmática —clásica de las ciencias jurídicas— y los submétodos sistemático, analítico y de enjuiciamiento de hecho, se observa críticamente la implementación de estos estándares en el contexto chileno y se analizan los mecanismos de justiciabilidad que buscan asegurar la protección y realización efectiva del derecho a la alimentación en un escenario de cambio climático. Por último, se concluye que es constrictivo adoptar medidas normativas de protección al derecho a la alimentación, que incorporen los estándares mínimos desarrollados en el ámbito del derecho internacional. Este fortalecimiento normativo contribuiría a moderar la pálida imagen del derecho climático nacional con casi ninguna referencia al derecho humano mencionado. | es-ES |
