The author argues that the key element that defines the existence of a democratic political system is the fact that the Constitution and the laws are the product of the majority will of the people, expressed in assemblies that represent them through a vote that has really the same value. He argues that in present Chile it is clear that the Constitution is not the product of the will of the majority because it was imposed by the dictatorship in a spurious plebiscite, and its contents constitute an authoritarian regime. The author along with developing these ideas, questions how the Concertación governments defined that the transition to democracy had been accomplished.El autor argumenta que el elemento clave que define la existencia de un sistema político democrático es el hecho que la Constitución y las leyes sean el producto de la voluntad mayoritaria del pueblo, expresada en asambleas que lo representen a través de un voto que tenga realmente el mismo valor. Sostiene que para el Chile actual es claro que la Constitución no es el producto de la voluntad mayoritaria del pueblo pues fue impuesta por la dictadura en un plebiscito espurio, y sus contenidos configuran un régimen autoritario. El autor junto con desarrollar estas ideas cuestiona cómo los gobiernos concertacionistas fueron dando por realizada la transición a la democracia.
