dc.descriptionOne of the aspects that has not been duly resolved in the field of patrimonial responsibility of the Administrative State in Chile, is related to the necessary requirements for it to be able to claim reimbursement against the official who has incurred in personal fault, as a result of what which, the State has been previously sentenced to pay the damages or losses caused. In this context, we will review and analyze the need for the administrative body, prior to deducing its repetitive action against the official, to initiate a disciplinary administrative procedure.en-US
dc.descriptionUno de los aspectos que no se encuentra debidamente resuelto en el ámbito de la responsabilidad patrimonial del Estado Administrador en Chile, dice relación con los requisitos necesarios para que este pueda accionar de reembolso en contra del funcionario que ha incurrido en falta personal, producto de lo cual, el Estado haya sido previamente condenado a pagar los daños o perjuicios ocasionados. En ese contexto, revisaremos y analizaremos la necesidad de que el organismo administrativo, previo a deducir su acción de repetición en contra del funcionario, instruya un procedimiento administrativo disciplinario. es-ES
