dc.descriptionThis paper defends the thesis that the will can be revoked by a public deed stating the explicit and unequivocal will of the deceased to render it void. The traditional thesis that only admits revocation by another will is discussed. It is maintained that there is no prohibition in the chilean Civil Code against it being carried out in any other way, nor is it stated that it can only be carried out by another will. When verifying the existence of a regulatory gap, the legal system must be completed or integrated with the principles that inspire inheritance law and our thesis is also corroborated by article 1135 of the chilean Civil Code regarding the alienation of the legacy.en-US
dc.descriptionEn este trabajo se defiende la tesis de que el testamento puede ser revocado por una escritura pública donde conste la voluntad explícita e inequívoca del causante de dejarlo sin efecto. Se discute la tesis tradicional que admite solo la revocación por otro testamento. Se sostiene que no existe en el Código Civil chileno una prohibición de que se realice de otra manera, ni tampoco se señala que sólo pueda realizarse por otro testamento. Al constatar la existencia de una laguna normativa debe completarse o integrarse el ordenamiento jurídico con los principios que inspiran el derecho sucesorio y además corrobora nuestra tesis el artículo 1135 del Código civil a propósito de la enajenación del legado.es-ES
dc.descriptionEste trabalho defende a tese de que o testamento pode ser revogado por escritura pública que declare a vontade explícita e inequívoca do falecido de torná-lo nulo. Discute-se a tese tradicional que só admite a revogação por outra vontade. Sustenta-se que não há proibição no Código Civil de que seja realizada de outra forma, nem se afirma que só possa ser realizada por outra vontade. Ao verificar a existência de lacuna regulatória, o ordenamento jurídico deve ser completado ou integrado aos princípios que inspiram o direito sucessório e nossa tese também é corroborada pelo artigo 1.135 do Código Civil no que diz respeito à alienação do legado.pt-BR
