The objective of this article is to examine the role that the general action of unjustified enrichment can assume to obtain the restitution of assets in our legal system. To this end, we study how and when the possession of other people’s assets constitutes unjustified enrichment and in which cases the enrichment action is operative, taking into account the rule of subsidiarity. Finally, the advantages of using the enrichment action in the restitution of property are evaluated.El presente artículo tiene por objetivo examinar el papel que puede asumir la acción general de enriquecimiento injustificado para obtener la restitución de bienes en nuestro ordenamiento jurídico. Para ello se estudia cómo y cuándo la detentación de bienes ajenos constituye un enriquecimiento injustificado y en qué casos la acción de enriquecimiento es operativa, tomando en cuenta la regla de la subsidiariedad. Por último, se evalúan las ventajas del uso de la acción de enriquecimiento en la restitución de bienes.
