dc.descriptionThis article analyses the notion of “neuro-rights” in the following way: first, by interpreting the new final paragraph of article 19 N°1 of the Chilean constitutional text reformed by Law 21.383 that modifies the Fundamental Charter, in order to establish scientific and technological development at the service of people; secondly, by explaining the concerns that constitutional dogmatics has highlighted regarding the regulation and protection of the so-called “neuro-rights”; thirdly, I will make some critical comments on the understanding of the constitutional reform referred to and the articulation of the incipient dogmatic concern for the intersection between technological and legal development.en-US
dc.descriptionEste artículo analiza la noción de “neuroderechos” del siguiente modo: primero, interpretando el nuevo inciso final del artículo 19 N°1, del texto constitucional chileno reformado por la ley 21.383 que modifica la Carta Fundamental, para establecer el desarrollo científico y tecnológico al servicio de las personas; en segundo lugar, explicitando las preocupaciones que la dogmática constitucional ha puesto de relieve respecto de la regulación y protección de los denominados neuroderechos; en tercer lugar, formularé algunos comentarios críticos a la comprensión de la reforma constitucional referida y a la articulación de la incipiente preocupación dogmática por la intersección entre el desarrollo tecnológico y el jurídico.es-ES
