A human rights challenge: Recent international decisions on access to voluntary termination of pregnancy

| dc.description | This article analyzes how the international human rights system has recently addressed the right to access to voluntary termination of pregnancy. It compares the recent decisions of the Inter-American Court of Human Rights (Beatriz case against El Salvador, 2024) and the United Nations Human Rights Committee in the (Susana, Lucía and Norma cases, 2025). While both bodies acknowledge human rights violations, the Court avoids declaring the absolute criminalization of abortion incompatible with the American Convention. In contrast, the United Nations (UN) Committee states that forcing motherhood in cases of sexual violence constitutes torture and gender-based discrimination. It urges states to review their legal frameworks and ensure access to the right to access voluntary termination of pregnancy services for all women. The article emphasizes that, although both systems reflect progress, the Committee’s approach is more effective in advancing abortion as a justiciable human right. In this context, it highlights the importance of strategic litigation and international feminist advocacy to challenge criminalization and uphold sexual and reproductive rights for women, girls, and people with the capacity to gestate. | en-US |
| dc.description | El artículo analiza el abordaje del derecho al acceso a la interrupción voluntaria del embarazo en el Sistema Internacional de Derechos Humanos, contrastando las decisiones recientes de la Corte Interamericana de Derechos Humanos (caso Beatriz Vs. El Salvador, 2024) y del Comité de Derechos Humanos de la ONU (casos Norma, Lucía y Susana, 2025). Si bien ambos órganos reconocen vulneraciones de derechos, la Corte evita pronunciarse sobre la inconvencionalidad de la penalización absoluta del aborto. En cambio, el Comité de la ONU afirma que forzar la maternidad en casos de violencia sexual constituye tortura y discriminación basada en género e insta a tomar medidas entre las que se incluye revisar el marco legal y asegurar que todas las mujeres tengan acceso al servicio de interrupción del embarazo. El artículo subraya que, aunque se evidencian avances, el enfoque del Comité resulta más eficaz para consolidar el acceso a la interrupción voluntaria del embarazo como un derecho humano exigible. En este marco, se destaca la importancia del litigio estratégico y la acción feminista internacional como herramientas para transformar contextos de criminalización y garantizar los derechos sexuales y reproductivos de mujeres, niñas y personas con capacidad de gestar. | es-ES |
