dc.descriptionThis article analyzes the concept of ecological transition and its use in the generation of public policies related to the climate crisis. It argues that the transition is neither a voluntary nor a governed process and uses systems theory to understand how a general transition also implies transitions in various regimes and niches. Subsequently, it notes that the legal approach to the ecological transition partially involves the incorporation of the concept of a just transition, which has undergone an integrative conceptual evolution but has not yet reached the necessary depth to address the challenge of the ecological transition.en-US
dc.descriptionEl presente artículo analiza el concepto de transición ecológica y su uso en la generación de políticas públicas relacionadas con la crisis climática. Junto con argumentar que la transición no es un proceso voluntario ni gobernado, utiliza un enfoque sistémico para comprender como una transición general significa también transiciones particulares endistintas escalas espacio-temporales y niveles, presentándose como un desafío complejo y no linear. En seguida, da cuenta de que el acercamiento que el derecho ha tenido a la transición ecológica pasa en parte por la incorporación del concepto de transición justa, el cual ha tenido una evolución conceptual integradora, pero aún no alcanza la profundidad necesaria para dar cuenta del desafío de la transición ecológica.es-ES
