dc.descriptionThis paper reflects on the incorporation of the gender perspective as a hermeneutical tool for women's access to justice. Specifically, it uses Miranda Fricker's notion of epistemic injustice to analyze the impact of epistemic absences on the legal world, which have impeded understanding of women's experiences of oppression and discrimination in international human rights law. In this sense, the gender perspective will be seen as an interpretive tool that allows for a hermeneutics of absences in law, thereby arguing that the judgments of the Inter-American Court of Human Rights constitute an act of epistemic justice, exemplified by gender violence and, paradigmatically, obstetric violence.en-US
dc.descriptionEste trabajo reflexiona sobre la incorporación de la perspectiva de género como una herramienta hermenéutica para el acceso a la justicia de las mujeres. En particular, se utiliza la noción de injusticia epistémica de Miranda Fricker para analizar el impacto de las ausencias epistémicas en el mundo jurídico, que han impedido comprender experiencias de opresión y discriminación de las mujeres en el derecho internacional de los derechos humanos. En tal sentido, la perspectiva de género será vista como una herramienta interpretativa que permite una hermenéutica de las ausencias en el derecho para, de ese modo, sostener que las sentencias de la Corte Interamericana de Derechos Humanos configuran un acto de justicia epistémica, lo que se ejemplifica por medio de la violencia de género y, paradigmáticamente, con la violencia obstétrica.es-ES
