Abstract
This paper is dedicated to the jurisprudential development of the control of conventionality, a term incorporated in 2006 in the judgment of the Almonacid Arellano v. Chile case. The study identifies Inter-American judgments prior to the use of the term, which specify State obligations, primarily jurisdictional, as well as the opinions of Inter-American Judge Sergio García Ramírez, to whom the term is often attributed. Furthermore, as a central part of the study of all Inter-American judgments, following the methodology outlined here, ninety-nine judgments issued between 2006 and 2025 that include the term under study were identified, and both quantitative and qualitative analysis was conducted on these. The study presents the results, identifying three stages: origin and development, less developed argumentation, and more recent development. Different approaches were also identified, such as complete descriptions, incorporation of new elements or jurisprudential advances, an abbreviated approach, or simply a reference to the term. The study is considered to contribute elements to the understanding of the conventionality control by identifying the main jurisprudential arguments. Este artículo está dedicado al desarrollo jurisprudencial del control de convencionalidad, término incorporado en 2006 en la sentencia del caso Almonacid Arellano con Chile. El estudio identifica sentencias interamericanas previas a la utilización del término que precisan las obligaciones estatales y principalmente jurisdiccionales, así como los votos particulares del juez interamericano, Sergio García Ramírez, a quien se suele atribuir la paternidad del término. Asimismo, como parte central del estudio del total de sentencias interamericanas, siguiendo la metodología que se precisa, se logró identificar noventa y nueve sentencias emitidas entre 2006 y 2025 que contemplan el término objeto de estudio, las que fueron analizadas tanto cuantitativa como cualitativamente. El estudio presenta los resultados, e identifica tres etapas: de origen y desarrollo, de menor desarrollo argumentativo y del desarrollo más reciente. Se identificaron también diferentes abordajes como descripciones completas, incorporación de nuevos elementos o avances jurisprudenciales, un abordaje abreviado o bien la sola referencia del término. Se considera que el estudio aporta elementos para el conocimiento del control de convencionalidad identificando las principales argumentaciones jurisprudenciales.
