Abstract
The Chilean State is responsible for unjustifiably or arbitrary erroneous conducts of the Public Ministry. This recognition is contained in the article 5 of the Constitutional Organic Law from the same ministry. Created as an autonomous entity, can compromise the patrimonial responsibility of the State for serious misconducts in the exercise of its powers, not covered by the article 19.7. i) of the Political Constitution, which also obliges the State to respond for the unjustifiably erroneous or arbitrary resolutions of the judges. Despite being inspired by that rule in the drafting of constitutional provision, it’s applicable in the scope of action of an entity that by express mandate of the Fundamental Law, cannot exercise jurisdictional functions. Although the application of this norm of responsibility has not been very frequent, it has expanded the spectrum situations in which the State is obliged to respond due to the impact on the rights of people who have suffered damage to their heritage that they are not obliged to bear. El Estado de Chile es responsable por las conductas injustificadamente erróneas o arbitrarias del Ministerio Público (MP). Este reconocimiento se contiene en el artículo 5 de la Ley Orgánica Constitucional del mismo ministerio. Creado como un ente constitucionalmente autónomo, puede comprometer la responsabilidad patrimonial del Estado por faltas graves en el ejercicio de sus facultades, no cubiertas por la norma del artículo 19, numeral 7, letra i de la Constitución Política de la República (CPR), que obliga a responder al Estado por las resoluciones injustificadamente erróneas o arbitrarias de los jueces. A pesar de que esta norma está inspirada en la redacción del precepto constitucional citado, es aplicable en el ámbito de acción de un ente que, por mandato expreso de la Ley Fundamental, no puede ejercer funciones jurisdiccionales. Aunque la aplicación de esa regla de responsabilidad no ha sido muy frecuente, ha ampliado el espectro de situaciones en que el Estado es obligado a responder por la afectación de derechos de personas que han sufrido daños en su patrimonio que no están obligadas a soportar.
