Public universities operate under a dual regulatory regime that structurally places them at a disadvantage in relation to their counterparts within the higher education system. On one hand, they are bound by the legal provisions governing organs of the State administration; on the other, they must adhere to the regulatory framework applicable to higher education institutions. The concurrent application of these normative regimes produces additional bureaucratic constraints and transaction costs that undermine the principles of efficiency and effectiveness. Overcoming these institutional asymmetries calls for the adoption of renewed regulatory frameworks that incorporate the most recent recommendations of the National Economic Prosecutor’s Office (FNE) and align with emerging legislative developments. Las universidades públicas tienen un doble régimen normativo que las deja en un plano de desigualdad frente a sus pares en el sistema de educación superior. Por un lado, se rigen por normas aplicables a los órganos de la Administración del Estado, y por otro, por las normas aplicables al sistema de educación superior. La aplicación conjunta de estas regulaciones genera mayores barreras burocráticas y costos de transacción asociados que atentan contra los principios de eficiencia y eficacia, lo que requiere ser subsanado mediante nuevas regulaciones que recojan las últimas recomendaciones de la Fiscalía Nacional Económica y las nuevas tendencias legislativas.
