Abstract
This article examines whether the suspension of voting rights under Article 16 No. 2 of the Chilean Constitution may be triggered solely by an indictment filed by the Public Prosecutor’s Office or requires prior judicial review. Drawing on the Electoral Qualification Tribunal’s judgment in Case 1978-2025, it contrasts a literal interpretation with a systematic reading of Articles 16 No. 2 and 83, the presumption of innocence, and the protection of political rights. It argues that an indictment alone is insufficient and that a final order opening the oral trial is the first judicial milestone capable of triggering the suspension. Este artículo examina si la suspensión del derecho a sufragio del artículo 16 número 2 de la Constitución puede producirse por una acusación del Ministerio Público o exige control judicial previo. A partir de la sentencia rol 1978-2025 del Tribunal Calificador de Elecciones, se contrasta una interpretación literal con una lectura sistemática de los artículos 16 número 2 y 83, la presunción de inocencia y la protección de los derechos políticos. Se sostiene que la acusación no basta y que el auto de apertura firme o ejecutoriado constituye el primer hito jurisdiccional apto para producir la suspensión
