Abstract
This paper examines the social function of property in Chile, with particular emphasis on the constraints it encounters in legal practice. To this end, it analyzes the theoretical, doctrinal, and case law development of the social obligations of property within the national legal framework, focusing on the main restrictions it faces: the guarantee of the essential content of property, the doctrine of regulatory taking, and the absolute statutory reservation. Subsequently, it will examine the law–regulation dynamics, offering various doctrinal, jurisprudential, and practical perspectives on the matter. It further assesses the implications of these regulatory constraints through an analysis of Constitutional Court Judgment 13626-22, regarding the Urban Wetlands Act.
