| dc.description | Resumen El trabajo examina la influencia de la obra de Theodor Viehweg en la teoría de la argumentación e interpretación constitucional, en particular, por medio de examinar su relación con la obra de Konrad Hesse. Se revisa el contexto histórico-jurídico de la obra de Viehweg, sus principales características, y la forma en que Hesse incorpora esas ideas al contexto constitucional, a propósito de las características de la Constitución en tanto norma abierta e indeterminada. ON THE INFLUENCE OF VIEHWEG’S TOPIK UND JURISPRUDENZ ON HESSE’S METHOD OF CONSTITUTIONAL INTERPRETATION Abstract The paper examines the influence of the work of Theodor Viehweg on the theory of constitutional argumentation and interpretation, particularly, by examining its relation to the work of Konrad Hesse. The legal-historical context of Viehweg’s work and its main characteristics are reviewed, as well as the manner in which Hesse integrates those ideas to a constitutional context, in relation to the characteristics of the Constitution as an open and indetermined norm.
