| dc.description | Este artículo comparte ciertas reflexiones sobre el proceso de debate llevado adelante durante 2011 y 2012 en el seno de la Organización de Estados Americanos acerca del funcionamiento de la Comisión Interamericana de Derechos Humanos y el fortalecimiento del sistema interamericano de derechos humanos. El artículo explica que si bien estos debates no son nuevos, el actual proceso se inició en un contexto complejo y de tensión entre los diversos actores del sistema interamericano. Luego, se centra más que en los temas de la agenda del debate propiamente tales, en aquellos problemas o deficiencias transversales que han surgido en el actual proceso de discusión. Estos serían el financiamiento de los órganos del sistema; la debilidad del sistema por la falta de universalidad; la disyuntiva entre las funciones de promoción y la protección de la Comisión Interamericana; la autonomía de la Comisión Interamericana para resolver sobre las recomendaciones de los Estados; y, finalmente, los cuestionamientos de los Estados a tutelas externas o supervisión internacional en un contexto democrático. | es-ES |
| dc.description | This paper reflects on the discussions carried out during 2011 and 2012 within the Organization of American States about the Inter-American Commission on Human Rights’ procedures and how to strengthen the Inter-American human rights system. The paper shows that, while these debates are not new, the current discussion started in a complex and tense environment for the various actors of the Inter-American system. Then, rather than looking at the items on the agenda, the paper examines the cross-cutting problems or deficiencies that have emerged in the current discussion process. These problems are: how to finance the bodies of the Inter-American system; the system’s weakness due to its lack of universality; the conflicts between the Inter-American Commission’s mandate to promote and to protect human rights; the Inter-American Human Rights Commission’s autonomy to decide on countries’ recommendations; and, finally, the reluctance of the States to accept external guardianships or international supervision within a democratic context. | en-US |
