El presente artículo analiza las consecuencias políticas de la así denominada “crisis de los refugiados” en la Unión Europea y las respuestas políticas que los Estados miembros han encontrado para solucionar dicha crisis, en especial, el acuerdo firmado entre la Unión Europea y Turquía, para argumentar que dicho acuerdo es un paso más en el proceso, actualmente en marcha, de relativización, recorte o incluso vaciamiento del derecho de asilo. Para ello se describirá, en un primer momento, las principales características del acuerdo, para, a continuación, demostrar que se trata de un acuerdo ilegal, ilegítimo e ineficaz y, finalmente, avanzar con una interpretación acerca de los motivos que pueden estar por detrás de la decisión de celebrar dicho acuerdo.This paper examines the political consequences of the so-called ‘refugee crisis’ in the EU and the political responses that member states have found to tackle the crisis. In particular, focus on the agreement signed by the EU and Turkey, to argue that the agreement goes a step further in the process of relativizing, curtailing, and hollowing out of the right of asylum that is currently underway. In order to do this, it is first described the main characteristics of the agreement, then showed that it amounts to an illegal, illegitimate and ineffective arrangement, and finally it is suggested an interpretation of the motives that may underlie the decision to enter into such an agreement.
