This article presents an overview of the situation of prison conditions in Latin America and the Caribbean and suggests guidelines for action. The author points to two crucial factors that must be taken into account: on the one hand, the physical space available in prisons and the issue of overcrowding and, on the other hand, the number, selection and education of prison staff. Both factors are analyzed empirically and the human rights violations that come about due to the current functioning of the region’s prison systems are evaluated. The author suggests following the United Nations Rights and Obligations Model, and taking successful reforms as a guide, he rejects the privatization of prisons as a viable alternative, and argues in favor of the implementation of integrated criminal justice and prison system reform programs, which must be accompanied by democratic and inclusive social policies in order to reduce income inequality.Este artículo presenta un estado de situación de los sistemas penitenciarios de América Latina y el Caribe y propone lineamientos para la acción. El autor señala dos factores cruciales a tener en consideración: el espacio físico en las prisiones y la sobrepoblación por un lado; y la cantidad, selección y formación del personal  penitenciario por otro. Ambos factores se analizan empíricamente, evaluando las violaciones de derechos humanos que se derivan del actual funcionamiento de los sistemas penitenciarios en la región. El autor propone seguir el modelo   penitenciario de derechos y obligaciones de las Naciones Unidas y, basándose en experiencias exitosas de reformas, descarta la privatización de las prisiones como una alternativa, y aboga por programas de reforma integral de los sistemas  penitenciarios y de justicia penal, que deben ir indispensablemente acompañados por políticas sociales democráticas e inclusivas, que reduzcan la inequidad de la distribución del ingreso.
