El presente trabajo analiza la primera sentencia sobre reparaciones dictada por la Corte Penal Internacional en el caso Fiscalía v. Lubanga Dyilo. Para ello, en primer lugar, se tratan ciertos elementos que ponen en contexto la sentencia: las dificultades para reparar violaciones graves de derechos humanos, la visión del “retorno de la víctima” al proceso penal y los antecedentes concretos del caso a analizar. Luego el artículo se centra en el desarrollo de los catorce principios sobre reparaciones enunciados en la resolución, analizando los aspectos positivos y negativos de estos estándares, recurriendo para ello al desarrollo del derecho penal internacional y del derecho internacional de los derechos humanos.This paper examines the first decision on reparations issued by the International Criminal Court in the case of Prosecutor v. Lubanga Dyilo. It first addresses a series of elements that contextualize the sentence: the difficulties to redress serious human rights violations, the question of “the return of the victim” in criminal procedure, and the specific background of the case being analyzed. Secondly, this paper focuses on the fourteen principles on reparations formulated in the judgment, and it examines the positive and negative impact of these standards. To do so, it draws on the development of international criminal law and international human rights law.
