| dc.description | This paper seeks to identify three forms of legal resistance though a sociohistorical analysis of the participation of lawyers and magistrates in the French resistance movement in during World War Two. The first refers to “resistance despite the law” and describes the antagonism between legalism and resistance that should have prevented lawyers from participating in the resistance movement. Second, “resistance in the shadow of the law” depicts how, progressively, the subversive potential of judicial professions were discovered and used. Third, “resistance in the name of the law” shows how legal arguments were used to justify and legitimate internal and external resistance. This threefold conception, analytical as well as chronological, is an invitation to a more complex analysis of the relationships between law and politics. | en-US |
| dc.description | Este artículo tiene como objetivo poner en evidencia tres formas de resistencia fundadas en el derecho, a partir de un análisis socio-histórico del compromiso de abogados y magistrados con la Resistencia en Francia durante la Segunda Guerra Mundial. La primera forma, “resistir a pesar del derecho”, remite al antagonismo entre el legalismo y la entrada en resistencia que constituía, muy especialmente para los juristas, un obstáculo al compromiso. La segunda forma, “a la sombra del derecho”, designa la manera en que progresivamente serán descubiertas y utilizadas las posibilidades de acción subversivas ofrecidas por estas profesiones, a condición de jugar un doble juego. Por último, “la resistencia en nombre del derecho” remite a la elaboración de argumentaciones jurídicas que justifican la Resistencia interior y exterior y que aportan a este combate la legitimidad del derecho. Esta tripartición, a la vez analítica y cronológica, invita, asimismo, a complejizar el análisis de las relaciones entre derecho y política. | es-ES |
