| dc.description | The article approaches various family aspects of free unions and its historical, legislative and judicial development in the territory of the republic of Colombia. The article qualitatively describes the constitution of the family prior the arrival of Spanish conquerors to America. The author describes and analyzes the Colombian judicial system, the regulation and the case-law regarding de facto unions, as an institution and means of recognition of rights. A succinct summary of laws and case law is provided, and it is shown how, through judicial decisions, the de facto unions have been developed. The article aims to demonstrate that case law has truly developed the institution. | en-US |
| dc.description | El artículo aborda diferentes aspectos de la familia conformada por uniones libres o convivenciales, su desarrollo histórico, legislativo y judicial en el territorio de la República de Colombia. Se describe cualitativamente la constitución de la familia desde antes de la llegada de los españoles a tierras americanas. Asimismo, se describe y analiza el sistema jurídico colombiano, la regulación normativa y el desarrollo jurisprudencial de la unión marital de hecho, como institución y medio de reconocimiento de derechos. En el texto podemos encontrar un resumen sucinto de las normas y la jurisprudencia proferida en torno al tema, y se muestra como, a través de sentencias judiciales, se ha desarrollado esta figura jurídica. Con este artículo de reflexión se apunta a demostrar que el verdadero desarrollo de la institución de la unión marital es eminentemente jurisprudencial. | es-ES |
