| dc.description | Analizamos la decisión de la Corte Suprema recaída en el proyecto Modificación Puerto Punta Totoralillo. En particular, examinamos críticamente a la luz del criterio de deferencia técnica, la interpretación amplia tomada por la Corte Suprema sobre la extensión de las competencias del Director Ejecutivo del Servicio de Evaluación Ambiental al resolver la reclamación administrativa establecida en el artículo 20 de la Ley N°19.300. A su vez, revisamos la consideración de la Corte Suprema relativa a que no fuese arbitrario someter al proyecto a las mismas exigencias que llevaron a la aprobación favorable del proyecto original. | es-ES |
| dc.description | We analysed the Supreme Court’s decision regarding the project Modificación Puerto Punta Totoralillo. Particularly, we critically reviewed from the technical deference criteria the wide interpretation made by the Supreme Court about the extension of the competences of the Executive Director of the Environmental Assessment Service when solving the claim established in the Article No. 20 of the Law No. 19,300. Furthermore, we reviewed the Supreme Court’s consideration regarding the non-arbitrariness of submitting the project to the same requirements that allowed the original project’s approval. | en-US |
