dc.descriptionEl fallo comentado fija y reafirma elementos y criterios sobre legitimación activa en materia de reclamo de ilegalidad municipal a partir del concepto de interés legítimo y la capacidad que tendrían ciertas normas de orden público, como los planes reguladores, para justificar el interés. La estructura del comentario consta de tres partes, la primera destinada a otorgar los elementos fundamentales del caso, el segundo apartado tratará sobre la legitimación activa y pasiva así como el interés legítimo en relación al fallo y la alternatividad en la decisión de la vía administrativa o judicial otorgada, el tercero sobre la interpretación de la Corte respecto de aquellos actos que afectan el interés general de la comuna. Las conclusiones se refieren a la reafirmación por parte de la Corte Suprema de la vigencia del recurso por exceso de poder en relación al reclamo de ilegalidad municipal. A su vez, este recurso, destinado a lograr la nulidad del acto requiere, a juicio de la Corte, solo del umbral del interés legítimo y no de la alegación de un derecho subjetivo para su interposición, a su vez que le otorga libertar al recurrente otorgándole una doble vía de reclamación en contra de los actos emanados del Director de Obras, garantizando con ello un mejor control de los actos de la Administración. El artículo finaliza con un Excursus relativo a la sentencia dictada por la Corte de Apelaciones de Valparaíso que, en cumplimiento de la sentencia de la Corte Suprema, resuelve el fondo del asunto basado en una interpretación teleológica de las normas de la OGUC y al uso hermenéutico del principio de la Planificación Urbana del Derecho Urbanístico.es-ES
dc.descriptionThe structure of this comment has three main sections. The first is about the principal elements of the case. The second is about legal standing as well the legitimate interests; the alternative that the Supreme Court gave to the part, the possibility to intend an administrative or judicial review process, and the interpretation about the administrative acts that affects the general interest in the counties. The conclusion is related to the reaffirmation of the Supreme Court about the existence and validation of the excess of power action in the judicial review of municipal acts. This action, for the nullity of the illegal decisions, needs just the thresholds legitimate interest, and not the allegation of subjective rights for the interposition, and gives two ways to reclaim the acts of the Municipality.en-US
