| dc.description | El presente trabajo describe las principales herramientas para mejorar y equilibrar la distribución de los impactos ambientales de un proyecto o actividad, desde la perspectiva de la justicia ambiental. Para lo anterior, primero se define justicia ambiental y se hace referencia a los orígenes del concepto, su inclusión normativa y la experiencia comparada. Posteriormente, el artículo se refiere al estado de la justicia ambiental en Chile y a algunos instrumentos políticos y regulatorios que abarcan de manera indirecta el concepto. Finalmente, se analizan la planificación territorial y la integración normativa del concepto de comunidades vulnerables, como los principales mecanismos para que exista mayor equidad ambiental. Con respecto al reconocimiento de comunidades vulnerables, se revisan a su vez sub-mecanismos derivados de dicho reconocimiento, tales como el acceso a la información, el equilibrio en las capacidades negociadoras de las partes y la participación ciudadana, entre otros. | es-ES |
| dc.description | The paper describes the main tools in order to enhance and equilibrate the environmental impacts distribution of a project or activity, from the environmental justice perspective. First, the article gives a definition of environmental justice and refers to the origins of the environmental justice movement, its normative incorporation and the comparative experience. Then, the article focuses on the environmental justice in Chile and on some legal tools, policies and regulations that indirectly integrates the environmental justice concept. Finally, the paper analyses two main regulatory tools associated to the environmental justice enhancement: the land use planning and the overburdened communities rights. In connection with the legal recognition of the overburdened communities concept, the paper reviews sub-mechanisms connected to the overburdened communities rights, such as the access to the information and a level the playing field in the negotiations processes, among others. | en-US |
