| dc.description | El proyecto Central Hidroeléctrica Río Cuervo ha sido a lo largo de los años objeto de numerosas acciones legales e impugnaciones, algunas de ellas han logrado su paralización (Corte Suprema Rol N° 2463-2012), mientras que otras ha sido rechazadas (Corte Suprema Rol N° 8774-2014). Este comentario reflexiona en torno a la sentencia dictada por el Tribunal Ambiental de Santiago bajo el Rol N° R-34-2014, que se encuentra firme, siendo dos los aspectos comentados. El primero trata la idea del agotamiento de la vía administrativa como regla jurisprudencial de los tribunales, abarcando sus múltiples manifestaciones en casos ambientales. La segunda reflexión abarca el concepto de riesgo, como base en la decisión del fallo, introduciendo la idea del riesgo como construcción social tomada de la Estrategia Internacional para la Reducción de Desastres de las Naciones Unidas. | es-ES |
| dc.description | The hydroelectric power plant project in the Río Cuervo river basin has been through the years object of litigation in Courts, some of them achieving the paralization of the environmental impact assessment process (Supreme Court of Justice, Nº 2463-2012), among other has been rejected (Supreme Court of Justice, N° 8774-2014). This case comment is about the Environmental Court of Santiago in the case R-34-2014, with two principal approaches. The first, the topic about exhausted available state administrative remedies in environmental cases.
