El artículo ofrece una interpretación del artículo 443 bis del Código Penal, incorporado por la Ley N° 20.601, que estableció un marco penal autónomo para el delito de robo con fuerza de cajeros automáticos, dispensadores o contenedores de dinero, o del dinero y valores contenidos en ellos. La modificación legal establece un especial tratamiento punitivo al atentado a ciertos objetos cuyas características específicas los hacen funcionales a la satisfacción de intereses individuales vinculados al acceso expedito y seguro a servicios y recursos financieros. Desde esa perspectiva, el artículo pretende determinar la estructura delictiva de la figura y precisar el sentido de los términos alusivos al objeto material del delito y las específicas modalidades de fuerza en las cosas descritas en la disposición.The paper provides an interpretation of article 443 bis of the Chilean Penal Code, incorporated under Law 20.601, which established a separate sentencing framework for burglary of automated teller machines, dispensers or containers of money, or the money and securities held within. The legal amendment provides a special punitive treatment for the attack of certain objects whose particular functional characteristics serve to satisfy individual interests related to the unobstructed access to financial services. According to this perspective, the paper aims to determine the structure of this crime, as well as to specify the meaning of legal terms regarding the material object of the offense and specific modalities of force described in article 443 bis.
